    These Terms of Service ("Terms") govern your access to and use of the Livio website (livio.co.za) and the purchase of products from us. By accessing our website or placing an order, you agree to be bound by these Terms. These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act, 2008 (CPA), the Electronic Communications and Transactions Act, 2002 (ECTA), and the Protection of Personal Information Act, 2013 (POPIA).

    2. Age Restriction

    You must be at least 18 years of age to use this website and purchase products from Livio. By using our website, you confirm that you are 18 years or older. This requirement is in accordance with the Films and Publications Act, 1996, and the Children's Act, 2005. We reserve the right to cancel any order or terminate any account if we have reason to believe the user is under 18 years of age.

    3. Products and Descriptions

    We make every effort to display our products accurately. However, we do not guarantee that product descriptions, images, or other content are entirely accurate, complete, or error-free. Products are intended for personal, private use by consenting adults.

    Certain products may include health and safety information. It is your responsibility to read and follow all product instructions and warnings. Livio is not liable for misuse of any product.

    4. Pricing and Payment

    • All prices are listed in South African Rand (ZAR) and include VAT where applicable.
    • We reserve the right to change prices at any time without prior notice, but price changes will not affect orders already confirmed.
    • Payment is processed via secure third-party payment providers (e.g. PayFast). We do not store your full payment card details.
    • An order is only confirmed once payment has been successfully processed and you receive an order confirmation.

    5. Delivery

    • We deliver throughout South Africa using reputable courier services.
    • Estimated delivery times are provided as guidelines and are not guaranteed.
    • All orders are shipped in discreet, plain packaging with no indication of the contents.
    • Risk of loss passes to you upon delivery to the specified address.
    • Shipping is calculated based on parcel weight using Courier Guy Economy Road rates: R90 (0–5 kg), R150 (6–15 kg), R200 (16–25 kg). Orders over R500 qualify for free delivery.

    6. Returns and Refunds

    In accordance with the Consumer Protection Act (CPA), the following return and refund policies apply:

    • Cooling-off period: For online purchases, you have a 7-day cooling-off period from the date of delivery during which you may return goods for a full refund, provided the goods are unused, unopened, and in their original packaging.
    • Hygiene exclusion: Due to the intimate nature of our products, items that have been opened, used, or where the hygiene seal has been broken cannot be returned for health and safety reasons. This exclusion is permitted under Section 44(3)(d) of the CPA.
    • Defective goods: If a product is defective or damaged upon arrival, you may return it within 6 months for a repair, replacement, or refund in accordance with Section 56 of the CPA.
    • Return process: Contact us at hello@livio.co.za to initiate a return. Return shipping costs are the responsibility of the buyer unless the product is defective.

    7. Privacy and Data Protection

    Your personal information is processed in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA). We are committed to protecting your privacy and handling your data responsibly.

    8. Intellectual Property

    All content on this website — including text, images, logos, product names, and design elements — is the intellectual property of Livio and is protected by South African copyright and trademark law. You may not reproduce, distribute, or use any content without our prior written consent.

    9. Prohibited Conduct

    You agree not to:

    • Use the website for any unlawful purpose.
    • Misrepresent your age or identity.
    • Attempt to gain unauthorised access to our systems.
    • Distribute, share, or resell products purchased from us for commercial purposes without authorisation.
    • Submit false or misleading information.

    10. Limitation of Liability

    To the maximum extent permitted by South African law, Livio shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our website or products. Our total liability for any claim shall not exceed the purchase price of the relevant product.

    11. Dispute Resolution

    Any disputes arising from these Terms shall be governed by the laws of the Republic of South Africa. We encourage you to contact us first to resolve any issue amicably. If a dispute cannot be resolved, it may be referred to the relevant consumer tribunal or court of competent jurisdiction in South Africa.
